Article 1: General Provisions
The e-commerce website of Obumu Africa GmbH provides customers with the option of purchasing products through its webshop. These
Terms of Service (“Terms”) apply to all orders placed by visitors (“Customers”) on this website. By placing an order, Customers accept
these Terms, to the exclusion of any other conditions. Additional Customer conditions are only valid if accepted in writing by Obumu Africa
GmbH.
Article 2: Price
·Prices for Swiss and EU Customers are listed in Swiss Francs (CHF) or Euro (EUR) and include VAT and applicable taxes.
·Obumu Africa GmbH doesn’t sell outside of Switzerland and EU.
·Product images are for illustration purposes only and may differ from the actual product.
Article 3: Availability
While we strive to keep all information accurate and up to date, errors or omissions may occur. Obumu Africa GmbH cannot be held liable
for any inaccuracies. Product availability is subject to stock and may change without notice.
Article 4: Online Purchases
During Pre-launch:Orders are placed by writing an email to : hello@obumu.africa with reference to the article name. Shipping and
payment mode will be confirmed by Obumu.The order gets only binding after reconfirmation from the client on total cost including
shipping. Accepted payment methods include: Wire Transfer, Cash and Twint (Switzerland only). Payment needs to be done after final
confirmation of delivery date, and before shipment.
After pre-launch: Orders are placed by adding items to the Shopify shopping cart and proceeding to checkout. Customers provide contact
and delivery details and choose their preferred shipping and payment method. Accepted payment methods include:
·Credit/Debit Cards
·PayPal
Orders are processed and shipped (if in stock) after payment confirmation. Obumu Africa GmbH reserves the right to refuse orders in case
of prior serious breaches.
Article 5: Delivery and Execution
·We ship within Switzerland and the EU.
·Delivery times and costs are communicated during checkout.
·The risk transfers to the Customer upon physical receipt of goods or to the carrier if the carrier was chosen by the Customer.
Article 6: Retention of Title
Ownership of goods remains with Obumu Africa GmbH until full payment is received. Customers must inform third parties of this retention
of title if necessary.
Article 7: Right of Withdrawal
Consumers have the right to withdraw from their purchase within 14 calendar days without providing reasons. To exercise this right,
Customers must notify us via hello@obumu.africa and return the products in their original condition within 14 days. Return shipping costs
are borne by the Customer.
Exceptions to the right of withdrawal:
·Custom-made or personalized items.
·Sealed goods unfit for return for hygiene reasons once unsealed (eg.earrings)
Refunds will be processed within 14 days of receiving the returned goods.
Article 8: Guarantee
We comply with statutory warranty rights under Swiss and EU law. Customers must provide proof of purchase to claim warranty. Damage
caused by misuse, accidents, or neglect is excluded from warranty coverage.

Article 10: Penalties for Non-Payment
In case of non-payment, Obumu Africa GmbH reserves the right to charge statutory interest and collection costs, and to reclaim delivered
but unpaid goods.
Article 11: Privacy
We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and the General Data Protection
Regulation (GDPR). For detailed information, please refer to our Privacy Policy.
Article 12: Use of Cookies
Our website uses cookies for technical functionality and analytics. Consent is requested for non-essential cookies. Users can adjust
cookie preferences in their browser settings.
Article 13: Invalidation – Non-relinquishment
If any provision of these Terms is invalid or unenforceable, the remaining provisions shall remain in effect. Failure to enforce any provision
does not imply waiver of that right.
Article 14: Amendments to the Terms
Obumu Africa GmbH reserves the right to amend these Terms at any time. The most recent version is always available on our website.
Article 15: Proof
Customers agree that electronic communications and backups serve as proof of transactions.
Article 16: Applicable Law and Jurisdiction
These Terms are governed by Swiss law. Any disputes shall fall under the exclusive jurisdiction of the competent courts of Zug,
Switzerland.
